The United States Food and Drug Administration has ordered to pay $2.6 billion to settle allegations that it illegally marketed prescription drugs to the general public for recreational purposes, including to boost the sales of Viagra.
The drug maker has denied the allegations but has agreed to settle a lawsuit filed by the government against the company, which is seeking to force the company to pay $1.5 billion in penalties and pay more than $4 billion in damages to victims.
The suit alleged that a former director of the National Community Health Centers, Dr. Nachum Katunian, illegally prescribed Viagra for his patients. Katunian has denied the allegations and is seeking to force the company to pay the full amount.
The lawsuit said that Katunian was unaware of the FDA’s decision to approve Viagra, and was only told of the drug’s safety issues when he was prescribed the drug. Katunian was also unaware of the FDA’s approval of the drug for recreational use.
“There was a delay in the approval of Viagra,” said Katunian, who has been a consultant for the manufacturer. “I never told anyone about it.”
“If we’re being honest, it’s important that we do a proper investigation and find out what happened,” he said. “We’ll never be able to force it to pass muster.”
Katunian and his company have agreed to pay $5.3 million in penalties and pay more than $4 billion in damages.
The lawsuit names Dr. Nachum Katunian as his personal representative. Katunian is the company’s chief executive officer, while Nachum Katunian is the president and chief operating officer. He is the former head of the Nachum Katunian Group, which is responsible for marketing and promotion of the drug, among other things.
“There is a risk of confusion and uncertainty in the relationship between the two of us,” Katunian said. “We don’t want to get caught in a trap.”
The company said in a statement: “Patients and their physicians have the right to be aware of the potential risks associated with the use of this medication and to seek appropriate medical advice if they have a medical reason to question its safety.”
The complaint said that Katunian, who is an active physician and is a member of the Nachum Katunian Group, and Nachum Katunian were aware of the FDA’s decision to approve Viagra but knew that the company did not have sufficient resources to properly conduct necessary safety screenings. Katunian and Nachum Katunian also knew that the company’s regulatory process had been inadequate in some of its investigations. In response, the company’s board of directors approved the FDA’s approval of Viagra for recreational use and, in June, received a report from the FDA that indicated that it had taken action to correct a delay in approval of Viagra.“Patients should be informed of the potential risks associated with the use of this drug, and the FDA has taken prompt, serious steps to address these risks,” the company’s statement said. “The company has been able to resolve the issues and successfully completed the necessary safety screenings for patients and their physicians.”
The FDA’s approval of Viagra was prompted by an ongoing investigation by the company into allegations that the company knew about the potential risks of the drug, including the potential for addiction, and that the FDA required Viagra to be prescribed in compliance with the drug’s regulatory requirements.
The company said in a statement that it had “not acted improperly” in its regulatory review of Viagra and “has made no efforts to minimize or address the risks associated with its use.”
